Publishing open access DOES NOT equate to being in compliance with U.S. funding agencies' public access compliance policies. Policies will vary by agency but many require researchers to deposit their accepted manuscripts in the agency's chosen repository. Publishing as Gold OA is not a requirement for Public Access compliance. Public access policies are the result of two White House Office of Science & Technology Policy Memos: the 2013 Holdren Memo and the 2022 Nelson Memo.

Publishers are aware of updates to funder policies and of the longstanding “federal purpose license” that legally allows NIH and other federal funders to share award products. There will be times when a publisher’s author agreement states a required embargo or includes other language inconsistent with federal public access policies.
Authors can use the following language to ensure your publisher is aware of your funder's public access requirements even if you sign their standard author agreement:
“This manuscript is the result of funding in whole or in part by the [name of federal agency]. It is subject to the agency’s Public Access Policy. Through acceptance of this federal funding, [name of federal agency] has been given a right to make this manuscript publicly available in [agency designated repository] upon the Official Date of Publication, as defined by the agency.”
There is a growing list of publishers with author agreements that comply with federal access policies by default, without additional costs for authors. You may also consider an “open access” publishing option that would make the version of record available through the publisher’s website. Many such journals—but not all—charge fees for open access publication.
